1. Agreement to Terms

By creating an account or using SpikePath, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. SpikePath is operated by SpikePath LLC.

2. Eligibility and Age Requirements

You must be at least 13 years old to create a SpikePath account. If you are under 18, a parent or legal guardian must review and consent to these terms on your behalf before you use the platform. SpikePath does not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will promptly delete their account and associated data.

3. Account Registration

You agree to provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Each person may only maintain one account.

4. Description of Service

SpikePath provides tools to help student-athletes manage their college recruiting process, including school browsing, coach directories, AI-powered matching, email draft generation, and pipeline tracking. SpikePath is not affiliated with, endorsed by, or a representative of the NCAA, NAIA, NJCAA, or any college athletic program or conference.

5. AI-Generated Content

SpikePath uses artificial intelligence (powered by Google Gemini) to generate email drafts, school matching results, and school summaries. You acknowledge and agree that:

• AI-generated content is provided as a suggestion and starting point only.
• You are solely responsible for reviewing, editing, and verifying AI-generated content before using or sending it.
• AI may produce inaccurate, incomplete, or inappropriate content. SpikePath does not guarantee the accuracy of any AI-generated output.
• SpikePath is not liable for any consequences arising from your use of AI-generated content, including emails sent to coaches.
• Your profile information is sent to third-party AI services (Google) to generate personalized content. See our Privacy Policy for details.

6. NCAA Compliance Disclaimer

SpikePath is a software tool, not a recruiting service, agent, or advisor. SpikePath does not guarantee NCAA eligibility, compliance with recruiting rules, or any specific recruiting outcome. You are solely responsible for understanding and complying with all applicable NCAA, NAIA, NJCAA, or other governing body rules and regulations. We recommend consulting your high school guidance counselor or an NCAA compliance resource for specific eligibility questions.

7. Subscriptions and Payments

SpikePath offers free and paid subscription plans. Paid plans are billed monthly through Stripe.

• Free: Limited to 10 schools and basic features.
• Pro ($39/mo): Unlimited schools, AI matching, email drafts, and tournament workflow.
• Elite ($79/mo): All Pro features plus advanced analytics and competition intelligence.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months. SpikePath reserves the right to change pricing with 30 days notice.

8. Acceptable Use

You agree not to:

• Use the platform to send spam, harass coaches, or engage in any abusive behavior.
• Scrape, copy, or redistribute coach contact information or school data outside the platform.
• Misrepresent your identity, athletic credentials, or academic qualifications.
• Attempt to circumvent security measures, rate limits, or subscription restrictions.
• Use the platform for any unlawful purpose.

9. Intellectual Property

SpikePath owns the platform, its design, aggregated data, AI prompts, and all related intellectual property. You retain ownership of the personal content you provide (profile information, communications, highlights). By using SpikePath, you grant us a limited license to use your content solely for the purpose of providing the service.

10. Limitation of Liability

SpikePath is provided “as is” without warranties of any kind, express or implied. We do not guarantee any specific recruiting outcomes, coach responses, scholarship offers, or admissions decisions. To the maximum extent permitted by law, SpikePath and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

11. Account Termination

SpikePath may suspend or terminate your account if you violate these terms. You may delete your account at any time through your settings or by contacting support@spikepath.app. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms of Service from time to time. If we make material changes, we will notify you via email or an in-app notice. Your continued use of SpikePath after changes take effect constitutes acceptance of the revised terms.
